These Terms of Use (the "Terms") govern your access to and use of joinsaaskit.com and its content (the "Site"). The Site is operated by Brookstone Digital Services LLC, doing business as SaaSKit ("SaaSKit", "we", "us", or "our"). By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. This covers the Site, not our services
These Terms cover browsing and interacting with the Site: reading pages, following links, booking a call, and contacting us. They do not govern any software development, consulting, or other paid work we may do for you.
Every buildout or engagement is covered by its own separate written agreement, such as a proposal, statement of work, or services agreement, signed by you and us. Where that agreement and these Terms overlap for the work it covers, that agreement controls. Using the Site, booking a call, or sending us information does not create a client relationship and does not obligate either of us to enter into one.
2. Using the Site
You may use the Site for lawful purposes to learn about what we do and to get in touch. You agree not to:
- use the Site in any way that breaks the law or infringes someone else's rights;
- copy, scrape, or harvest content or data from the Site by automated means without our written permission;
- attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- interfere with or disrupt the Site, or introduce malware or other harmful code;
- misrepresent your identity or the accuracy of information you give us.
3. Intellectual property
The Site and its content, including text, layout, graphics, logos, and the SaaSKit name and marks, are owned by or licensed to Brookstone Digital Services LLC and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable right to view the Site for its intended purpose. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.
This section does not affect ownership of software we build for clients. Ownership of that work is set out in the applicable engagement agreement.
4. Booking a call and communications
When you book a call or contact us, you agree to provide accurate information. Scheduling a call is an invitation to talk, not a commitment by us to provide services, and not a guarantee that we will take on your project. Unless we have signed a confidentiality or other agreement with you, information you share through the Site is not treated as confidential. Scheduling is handled by a third-party provider, and your use of it is also subject to that provider's terms.
5. Third-party links and content
The Site links to and embeds third-party services and content, including our scheduling tool, embedded videos, our other products, and review platforms. We do not control those third parties and are not responsible for their content, availability, or practices. Following a link or using an embedded service is at your own risk and may be governed by that third party's own terms and privacy policy.
6. No guarantees
The Site is provided for general information about our work. We make no promises about specific outcomes. Any revenue or results from software we build depend entirely on your business, market, pricing, and execution, and we make no guarantee regarding income, sales, or results. We do not warrant that the Site will be accurate, complete, current, uninterrupted, or error-free.
7. Disclaimers and limitation of liability
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, Brookstone Digital Services LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnification
You agree to indemnify and hold harmless Brookstone Digital Services LLC and the people who work with it from any claims, losses, or expenses that arise out of your misuse of the Site or your breach of these Terms.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws rules. Any dispute relating to the Site will be brought in the state or federal courts located in that state, and you consent to their jurisdiction.
